1. Ownership

Woohoo Bingo (www.woohoobingo.com) is a wholly-owned free bingo website operated by Newcastle Marketing Services Ltd.

The copyright, database rights and other intellectual property rights (“IPR”) in material displayed on or via this website (“Website Materials” which expression includes text, data, graphics, photographs, videos, animation, images and audio visual content) is owned by or licensed to Woohoobingo.com or the owners of third party websites. This IPR is protected by the laws of England and Wales, international treaties and all other applicable copyright and intellectual property laws. Any unauthorised copying or distribution is strictly prohibited and legal action will be taken against any violators.

2. Restrictions On Use

2.1.1 YOU MUST NOT REGISTER OR SEEK TO REGISTER WITH WOOHOOBINGO.COM OR PLAY ANY OF THE GAMES ON THIS WEBSITE ("THE GAMES") IF ANY OF THE FOLLOWING APPLY:

2.1.2 YOU ARE LOCATED IN A JURISDICTION IN WHICH SUCH REGISTRATION AND/OR PLAYING ANY OF THE GAMES IS UNLAWFUL OR CONTRARY TO ANY APPLICABLE REGULATION. IT IS YOUR RESPONSIBILITY TO ENSURE THAT THIS IS NOT THE CASE;

2.1.4 YOU ARE UNDER 18 YEARS OF AGE;

2.1.5 YOU ARE NOT ACTING AS PRINCIPAL AND ARE ACTING ON BEHALF OF SOMEONE ELSE;

2.1.6 YOU ARE AN EMPLOYEE OF NEWCASTLE MARKETING SERVICES LTD OR ANY OF ITS SUBSIDIARIES OR AN EMPLOYEE OF ANY OF NEWCASTLE MARKETING SERVICES LTD THIRD PARTY CONTRACTORS SUCH AS LICENSORS, SOFTWARE SUPPLIERS OR DEVELOPERS.

By seeking to register with Woohoobingo.com and by playing any of the Games you hereby confirm to Woohoobingo.com Ltd that at all such times you -

  1. are located in a jurisdiction in which it is lawful to so register and play the Games;
  2. are not located in any of the jurisdictions referred to in 2.1.3 above;
  3. are aged 18 years or over;
  4. are acting as principal and not on behalf of anyone else, and
  5. are not an employee of Newcastle Marketing Services Ltd or any third party contractors such as licensors, software suppliers or developers.

Persons in breach of 1 or 2 or otherwise in breach of these terms will not be entitled to collect any winnings. FURTHERMORE ANY PERSON WHO IS KNOWINGLY IN BREACH OF 1 OR 2 IS COMMITING FRAUD AND MAY BE SUBJECT TO CRIMINAL PROSECUTION.

2.2 You must not play or seek to play any of the Games unless you have registered with Woohoobingo.com or have been specifically granted permission to do so as a guest by Woohoobingo.com.

2.3 You agree to abide by the rules of each of the Games as published on this website from time to time. Such rules form part of and are incorporated in these terms.

2.4 You hereby confirm to Woohoobingo.com that all information provided to Woohoobingo.com in your registration and in connection with your account and all personal information provided subsequently to Woohoobingo.com is complete, accurate and not misleading and you agree to inform Woohoobingo.com immediately if there is any change to such information. This can be done by e-mailing us at support@woohoobingo.com or updating your account profile.

You hereby confirm that you fully understand the standards and laws, as such standards and laws relate to the Games, of the community/legal jurisdiction where you are resident.

3. REGISTRATION

3.1 At registration we will request a email address and password for security purposes. The password that you choose must be kept private and secure by you at all times. Failure to do so could lead to unauthorised activities on your account. Transactions made using your account email address and password are accepted by us on the understanding that you are playing the Games. If an alternative source has accessed your account and we are not informed, we accept no liability for monies or information lost or misused.

3.2 Multiple Accounts - You are only permitted to have one account with Woohoo Bingo. In the case of multiple accounts belonging to the same person, we reserve the right to ask for identification before authorising the claiming of prizes. If any individual is found to be using multiple accounts, we reserve the right to close all associated accounts and void all points and stars balances. If an account is closed by request of the member, a new account cannot be opened for 6 months following the date of closure. In the case of any disputes over prizes and accounts authenticity, the decision of Woohoo Bingo is final. If you close your account before a prize from Woohoo Bingo has been sent out, the prize redeemed for will be void.

3.3 We reserve the right to ask for proof of age and evidence to verify your identity at any time and will be carrying out regular checks of our members. We reserve the right to conduct checks against any of the details provided to us and pursue this information through any channels and methods available to us. Failure to provide substantiated proof of age or other requested information will result in the suspension of your account. Any monies due or requested during this time will be withheld unless the requested information is provided. If you are required to provide identification you will receive an email detailing what you need to provide. Failure to provide the requested information within 3 months of our asking will deem the prize void. There will be no refund of Gold Stars.

3.4 Woohoobingo.com reserves the right to refuse to register you and/or to suspend and/or terminate your registration and/or account at any time in each case in our sole and absolute discretion and we shall not be obliged to provide you with any reasons for so doing. Furthermore, we reserve the right to refund to you or withhold any stars or monies (as cash prizes) from or into your account if there is manipulation of our financial system or suspicion or evidence thereof or a breach or suspected breach of any applicable law, regulation or any of these terms, in each case without providing any reason. Use of any account otherwise than in accordance with these terms or any other abuse of any account is strictly prohibited.

3.5 We reserve the right to suspend and/or terminate your registration and/or account immediately and without consultation, notification or giving reasons therefore in the event that you cause to be published on, and/or send via, our website or by playing any of the Games any actual or potentially defamatory, offensive or obscene language or material or if you are in breach, or are suspected of any breach of, any applicable law or regulation or should we deem it in the best interests of Woohoobingo.com to do so. This applies also to your registration details, completed challenges and to breach by you of our privacy policy.

3.6 We reserve the right to suspend and/or terminate your registration and/or account immediately and without consultation, notification or giving reasons therefore in the event that you are found to be exploiting a technical issue or glitch with any of our challenges in order to gain yourself a higher points balance or daily points recharge. Any technical issues related to the website or challenges should be reported to support@woohoobingo.com immediately.

3.7 Use of the website will be closely monitored to ensure that no customer is using the site with a frequency or in a manner which might suggest that he or she is not using it for personal use (on behalf of another), and we reserve the right to withhold any monies and/or suspend and/or terminate the registration and/or account if we consider that the site is so being used.

3.8 If an account is inactive for a period of 12 months, all Stars accrued will be voided. This will not affect the points balance of the account.

4. UPDATES

You acknowledge that these terms are subject to change by Woohoobingo.com, which reserves the right to change them at any time. Such changes shall have effect immediately upon publication on this site and you agree to be bound by them and to regularly review, print off and retain a copy of these terms for the purposes of monitoring such changes. These terms were last updated on 26th April 2012.

5. COPYING

5.1 Save as expressly provided in the terms below, any downloading, use or copying of Website and / or Mobile Materials is strictly prohibited and, in particular, you agree to use the Website and / or Mobile Materials solely for your own personal, non-commercial use and specifically not for any business, commercial or public purpose.

5.2 The following activities are prohibited without the express prior written permission of Woohoobingo.com -

  1. the deployment within this website of any spider, robot, web crawler or other automated query program; and
  2. the re-use and/or aggregation of any of the Website Materials in the provision of a commercial service

5.3 The copying and use of third party Website Materials accessed via this website is governed by the terms of use applicable to the third party site which you have accessed.

6. YOUR ACCOUNT

6.1 In order to play on any of the Games, you must open and maintain an account with us.

6.2 Only games played from accounts set up through Woohoobingo.com will be accepted for the Games

6.3 Charges and proceedings may be brought against you or any other person who has manipulated, or tried to manipulate, our service, any of the Games or your or any other customer's account(s) and we reserve the right to pass on such information as we deem relevant to the relevant authorities if we become aware or suspect that you are involved in any such activities. We are not obliged to inform you of the same, nor to give any reasons for doing so. You agree to waive any and all rights you may have, at law or otherwise, of whatever nature and in whatever jurisdiction, in connection with such disclosure.

6.4 Subject to the provisions of these terms, you can redeem cash prizes from your account up to valid online wallets such as but not necessarily including; Paypal, Neteller, Paysafecard and Moneybookers There are minimum and maximum limits on the amounts that you can redeem from your account. You are not permitted to redeem for a cash prize more than once from your account in any 31 day period. If you redeem for a cash prize more than once from your account within any one month period, only one prize will be sent out. The remaining Gold Stars used will be refunded to your account. This does not apply to exchanging stars for points, any badges or special badges, or Crown Bingo cash.

6.5 Points cannot be redeemed for any prizes at all and can only be used to purchase tickets on bingo.

6.6 To maintain a high level of security to protect your account, you accept that we will perform random security checks and keep records of transactions. You accept that we may demand additional documentation in the event of a security check and that we may terminate and/or suspend your registration and/or account and/or withhold payment to you if we do not receive such documentation. In addition, we will not register you unless you provide us with the correct documentation requested of you in order to verify your identity.

6.7 If any of your personal account details or other information relevant to your account change, you must inform us immediately, as failure to do so may result in transactions being declined. We will not accept any liability or responsibility for transactions which are declined as a result of incorrect details where you have failed to make us aware of any changes/correct details.

6.8 We reserve the right to terminate the provision of your account and gaming service at any time.

7. LICENCE TO USE SOFTWARE

7.1 We grant you a personal, non-exclusive, royalty-free, non-assignable and non-transferable licence to use the software for the Games (the 'Software') strictly for participation only in the Games in accordance with these terms and the rules of the Games. 8. SECURITY POLICY

9. RULES GOVERNING ALL GAMES

9.1 You agree not to interrupt or attempt to interrupt the operation of the website or of the normal playing of any of the Games. Your participation in the Games will be null and void if we discover that you have in any way interrupted or tampered with the Game.

9.2 You agree that Woohoobingo.com and its records shall be the final authority in determining the terms of any games you played and the winning result.

9.3 Any applicable taxes and fees in connection with any winnings awarded to you or any other payments to you are your sole responsibility. Winnings cannot be transferred, substituted or redeemed for any other monies.

9.4 You acknowledge that full freedom from errors and incompleteness is impossible to achieve with respect to computer software. If you become aware that the Software contains any error, or is incomplete, you shall promptly notify Woohoobingo.com by e-mail to support@woohoobingo.com upon becoming aware of such error or incompleteness. You undertake to refrain from taking any advantage whatsoever, either knowingly or otherwise, of that error or incompleteness and we reserve the right to recover any such advantage that you do gain from such error or incompleteness, as well as all associated costs, damages and expenses in making such recovery.

10. OUR LIABILITY

10.1 You agree to indemnify Woohoobingo.com and Newcastle Marketing Services Ltd in respect of any liability, damages, costs or claims which it may suffer arising out of or in connection with your use of the site or otherwise arising out of or in connection with our services. Your statutory rights as a consumer (if any) are not affected by these terms.

10.2 In particular Newcastle Marketing Services Ltd shall not be held liable or responsible for any consequences that occur through your use of our services where the circumstances that caused such consequences were beyond our reasonable control, including any loss or damage that has arisen through our site, our Games or our services or their content, including delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of our site or any error or omission in content.

10.3. Newcastle Marketing Services Ltd accepts no responsibility and shall not be liable to you for the content of or use by you of any information or services offered by third parties advertising (including advertising by any referral companies) or otherwise posting information via our site (whether directly or via links to or from other sites or resources or through framing or other electronic mechanisms) nor can Newcastle Marketing Services Ltd be said to endorse the contents of such advertisements or information. In particular, we shall have no liability in respect of material hyper-linked to our web pages which may be misleading, inaccurate, defamatory, threatening or obscene or otherwise not in accordance with applicable laws or regulations and the provision by us of a link to another website does not constitute any authorisation to access materials held at that location.

10.4 We reserve the right to modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.

The name and associated logo of Woohoobingo.com are in the process of being registered trademarks of Woohoo Bingo. The display of any trade names or trade marks within the Website Materials does not imply that any licence has been granted to any third party in respect of the same. All other product or company names, devices, logos, icons, graphics or designs referred to in the Website Materials are the trade marks of the respective owners and are exhibited only in such a manner as is intended to be for the benefit of such trademark owners. We intend no infringement of such trade marks. The appearance of products, services, companies, organisations, home pages or other websites on this website does not imply any endorsement thereof by us.

12. PRIVACY POLICY AND DATA PROTECTION CONSENT

12.1 BY AGREEING TO THESE TERMS YOU AGREE TO THE TERMS OF OUR DATA PRIVACY POLICY AND DATA CONSENT. SUCH POLICY AND CONSENT IS INCORPORATED IN AND FORMS PART OF THESE TERMS.

12.3 In accordance with applicable UK data protection legislation we reserve the right to charge a fee for providing such information.

12.4 The Service provider sharing data with the relevant authorities in the event of suspected fraudulent or suspicious behaviour on a player account or misuse of the software.

13. SUBMISSION OF INFORMATION

Save for personal information (which shall be dealt with in accordance with our Data Privacy Policy), all information (including but not Ltd to ideas, suggestions, concepts and graphics) submitted to us or other players through this website will become our exclusive property and we shall not be subject to any obligation of confidentiality and will be free to use the information for any purpose.

However, we retain the right to bring legal proceedings in any jurisdiction where we believe that infringement of our intellectual property rights or breach of these terms is taking place or originating. You are responsible for compliance with any applicable laws and regulations of the jurisdiction from which you are accessing this website.

16. GENERAL TERMS

16.1. All games at Woohoobingo.com are 100% Free. There are no fees associated with playing or winning our game. Our games are 100% fair. Numbers are randomly generated by our sophisticated Random Number Generator software.

16.2. All bingo game tickets are purchased using the "Points" currency at Woohoobingo.com. "Points" have no monetary value and cannot be redeemed for cash or prizes. Points may only be used to purchase bingo tickets.

16.3. Woohoobingo.com reserves the right, in its sole discretion and without notice, to add new features to the website and bingo games or to discontinue some activities/features at any time.

16.4. Gold star prizes in the Woohoobingo.com shop can only be redeemed by players within the UK and Northern Ireland. Players located outside of the UK and Northern Ireland are free to register and play, and to redeem bronze and silver stars for profile upgrades and promotional bonuses, however they are not permitted to redeem any gold stars for prizes with actual monetary value. By registering with Woohoobingo.com you agree to these conditions.

16.5. All games are fair and are decided by sophisticated random number generator software. Game results cannot be disputed and the decision of the Bingo Manager is final. The result of games on the bingo server's software shall be official and governing result of the game in all cases.

16.6. You are not permitted to purchase bingo tickets in more than one bingo room at the same time.

17. CHAT ROOM TERMS

17.1 Woohoobingo.com reserves the right to cancel your account for any reason whatsoever at any time without notice to you. This may occur under, but not exclusively in, the following circumstances. The following can result in termination of your account / loss of chat privileges and/or forfeiture of any winnings:

  • Posting details of any other websites in the chat room, unless it is directly related to Woohoo Bingo, or is needed to complete a challenge.
  • Offensive Behaviour / Language in Chat
  • Having/Using more than one account per participating website.
  • Using multiple windows or other methods to be in more than 1 Bingo room at a time.
  • Abuse/Harassment of Website, Game, Staff or other Players.
  • Spamming/Solicitation in Chat. This includes repetition of the same message or broadcasting of advertisements.
  • If you provide incorrect or misleading registration information.
  • If you are not of legal age.
  • If you reside in a jurisdiction where participation in the Game is prohibited by law.
  • If you have allowed or permitted (intentionally or unintentionally) someone else to play on your Bingo account.
  • If you have played Bingo at Woohoobingo.com for reasons other than individual personal entertainment (in other words if you have played in a professional sense or in conjunction with other player(s) as part of a club, or group etc.).

18. PROMOTIONS AND PRIZES TERMS

18.1 By registering with Woohoobingo.com you agree to the promotional rules set out in this Clause, together with any other specific entry instructions or rules posted on this Website by Newcastle Marketing Services Ltd, shall apply.

18.2 All competitions, promotions, prizes or other give-aways offered by Woohoobingo.com from this Website are only open to UK and Northern Ireland residents who are registered on the Website who are aged 18 or over.

18.3 For the purposes of the Data Protection Act 1998, you acknowledge that in the course of entering a Competition on this Website, certain personal information or data about you will be captured electronically or otherwise and transmitted to Woohoo Bingo. By entering into any Competition, you expressly agree to transfer such personal information or data to Woohoo Bingo to use, store and process the personal information for the purposes of such Competition on this Website. Please check our privacy policy and refer to the registration page for your right to opt out of receiving information from Woohoo Bingo.

18.4 By registering with Woohoobingo.com, you agree to the use of your name and photographs in your profile for publicity material in any of Newcastle Marketing Services Ltd publications in any media, including allowing your name to be published on the Website if you are a prize winner.

18.5 Unless specifically stated, no purchase is necessary to enter any competitions or redeem any prizes on the Website.

18.6 Newcastle Marketing Services Ltd will not offer cash alternatives in whole or in part for any prizes offered.

18.7 Newcastle Marketing Services Ltd reserves the right without notice to you, to remove any, Prizes, Promotions or competitions from the Website or to suspend or alter any of these on the Website, at its sole discretion for legal or technical reasons.

18.8 Any time of delivery is an estimate only in respect of the delivery to an Entrant of any prize in any Competitions and Newcastle Marketing Services Ltd shall not be liable for any late delivery of the prizes or any loss or damage caused as a result.

18.9 Although every effort will be made to supply the prizes stated, Newcastle Marketing Services Ltd cannot guarantee that the particular prizes will be available and an equivalent prize may therefore be offered by Newcastle Marketing Services Ltd in such cases.

No responsibility can be accepted by Newcastle Marketing Services Ltd for the quality and/or suitability of any prizes provided by third parties.

Once a physical voucher (Highstreet Voucher, Tesco Giftcard) has been posted, we are no longer responsible for the actions, loss or damages caused by any such 3rd Party Vouchers and cannot be held liable for any lack of delivery or any cost or time involved in disputes.

With specific regards to Amazon.co.uk Vouchers, once we have recieved email confirmation from Amazon.co.uk that the vouchers have been emailed to your registered email address on your Woohoo Bingo Account, at this point we are no longer responsible for the actions, loss or damages caused by any such 3rd Party Vouchers and cannot be held liable for any lack of delivery or any cost or time involved in disputes. All Amazon.co.uk vouchers that are unclaimed within 60 days of issue will be voided, without any refund of redeemed stars.

18.10 Any banned players void all rights to redeemed prizes in the Woohoo Bingo Shop. Any players who return to Woohoo Bingo following a ban, will not receive redeemed prizes for one month after their most recent ban - there will be no refund of Gold Stars if prizes are redeemed within this time. Any players found to have multiple accounts from the same IP also void all rights to redeemed prizes.

18.11 You are not eligible to receive any prizes on Woohoo Bingo if you are an employee of Newcastle Marketing Services Ltd or a member of an employee's immediate family, or employed by any of its subsidiaries or third party contractors such as licensors, software suppliers or developers.

19. PRIVACY POLICY

19.1 We will collect information about your personal details when you tell us what these are and by analysis of traffic on the Website, including by using cookies.

19.5 In addition, we may provide aggregate statistics about our services, competitions, clients, traffic patterns and other site information to third parties, but these statistics will not include any information that could personally identify you. In the event that your personal details become untrue, inaccurate or incomplete, or in any event, you have the right to access your personal details and may rectify the same.

You agree that you do not object to us, our associated companies or such third parties contacting you for any of the above purposes whether by telephone, email, fax or in writing, and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Telecommunications (Data Protection and Privacy) Regulations 1999.
